Bill to lower elective absentee voting age passes committee

SB 2128, which will allow persons age 60 and older to vote absentee upon request, passed the Senate's State and Local Government Commitee today.

The bill conforms to current law which allows persons, 60 and older, to obtain a driver's license without a photo, said sponsor Senator Bill Ketron.

Absentee voters are not required to show a photo ID to vote. Voting at the polls requires presenting a valid photo ID, as of January 1, 2012.

Th bill now goes to the Senate Finance Committee.

Jaclyn's Law passes House Judiciary Committee

"Jaclyn's Law", HB 2215, which gives immunity to first responders for property damage caused by forcible entry when responding to a medical call.

The bill was amended to remove language which would have given immunity for criminal conduct of first responders.

Sponsor Glenn Casada said the intent is to provide immunity for civil damages.

The bill is named for a California woman who died after first responders failed to use forcible entry, because of liability concerns.

About Estate Taxes:

As you all know, I am proposing to raise the exemption level on the estate tax in Tennessee. This year's budget would raise the exemption from $1 million to $1.25 million, with a goal of reaching the federal exemption level of $5 million while I am governor. I am convinced that our current estate tax is chasing people and capital out of our state and discourages people who don't live here from investing here. Quite simply, the only way new jobs get created is when people are willing to invest capital. At a time like this, when the economy is still struggling to rebound, I want to do everything I can to encourage people to invest their capital in Tennessee.

Likewise, many of you have long expressed a desire to decrease the tax on groceries in Tennessee. This budget proposes to do just that: taking the state portion of the sales tax on groceries from 5.5 percent to 5 percent over the next three years.

The notice shall contain a statement that alerts the respondent that he may lose all rights, liberties, property and freedom if conservatorship is granted.
Petition for appointment of a conservator shall not be held ex parte unless three physicians provide sworn affidavits that it would be detrimental to the respondent's health if he were to attend the hearing.

SB2249, filed as part of Governor Bill Haslam's administration package, contains the following language which will make the Tennessee Commission on Aging and Disability's executive director a governor appointee.

The bill also reduces the commission size from 26 members to 22. There will only be one representative from each of the nine planning districts in the state, with no distinction of urban and rural, which is reduced from two. TennCare shall receive a seat on the commission, as well.

The changes would take place as of July 1, 2012.

SECTION 14. Tennessee Code Annotated, Section 71-2-104, is amended by deleting

subsection (b) in its entirety and by substituting instead the following:

(b) The commission shall consist of twenty-two (22) members, who shall be

persons who provide leadership in programs for the elderly and disabled in the state.

Nineteen (19) of the members shall be appointed by the governor, in accordance with

the provisions of this part. Members may come from such diverse areas as housing,

recreation, employment, medicine, nursing, social service, business, adult education,

long-term care, religion, research and advocacy. It is desirable that the commission

membership reflect the geographic diversity of the state, and include minorities and

women at least in proportion to their presence in the state's population and that at least

one-half (1/2) of the membership be representative of the population served. Staff

members of programs funded wholly or in part by the commission shall be ineligible to

serve as commission members.

SECTION 15. Tennessee Code Annotated, Section 71-2-104(c), is amended by

deleting subdivision (1) in its entirety and by substituting instead the following language:

(1) Members of the commission shall be appointed as follows:

(A) One (1) person shall be appointed by the governor from each of the

nine (9) planning and service areas, in consultation with each of the nine (9)

advisory councils to the nine (9) area agencies on aging. The governor may

appoint such persons from a list of two (2) persons nominated by each advisory

council to the nine (9) area agencies on aging. Nothing shall preclude members

of the advisory councils from being appointed as commission members;

(B) One (1) member of the governor’s personal staff, who shall be

appointed by the governor;

organization that advocates exclusively for older persons shall be appointed by

the governor. Each such organization may submit two (2) nominations for

consideration by the governor;

(D) One (1) person who is an active member of a federally chartered

organization with statewide membership and chapters chartered in this state, that

advocates exclusively for older persons, shall be appointed by the governor.

Each such organization may submit two (2) nominations for consideration by the

governor;

(E) One (1) person who is an active member of a chartered, statewide

organization that advocates exclusively for disabled persons shall be appointed

by the governor. Each such organization may submit two (2) nominations for

consideration by the governor;

(F) The commissioners of the departments of human services, health,

veterans' affairs, mental health, and intellectual and developmental disabilities,

and the director of TennCare or their designees;

(G) The executive director of the council on developmental disabilities;

and

(H) The speaker of the senate and the speaker of the house of

representatives each shall name one (1) legislator from such speaker's

respective house to serve on the commission as ex officio members without

voting power to attend and sit with the commission in open meetings, in order to

report back to the general assembly on actions being taken or considered by the

commission.

SECTION 16. Tennessee Code Annotated, Section 71-2-104(e), is amended by

deleting subdivision (1) and by substituting instead the following:

(1) Members appointed to serve on the commission pursuant to this section shall

be appointed in accordance with the criteria established in this section. Members of the

commission as it existed prior to July 1, 2012, may be eligible for nomination and

appointment pursuant to the criteria established in this section.

SECTION 17. Tennessee Code Annotated, Section 71-2-105(a), is amended by

deleting subdivision (9) and renumbering the remaining subdivisions accordingly.

SECTION 18. Tennessee Code Annotated, Section 71-2-107, is amended by deleting

subsection (a) in its entirety and by substituting instead the following:

(a) The governor shall appoint the executive director. The executive director

shall be the chief administrative officer of the commission. The director shall be a fulltime

employee of the commission and shall have such education as deemed necessary

by the governor, with a minimum of five (5) years experience in the fields of aging or

disability or administrative experience necessary to properly operate and manage the

programs under this part. The executive director shall have the authority to conduct

ordinary and necessary business in the name of the commission in accordance with the

provisions of this part and as determined by the commission from time to time.

ACLU challenges Wisconsin Voter ID law

The American Civil Liberties Union filed a federal lawsuit on Tuesday to challenge Wisconsin's voter ID law, saying it deprives citizens of their right to vote.

Tennessee passed a similar bill last year, requiring a government issued ID to be presented at the polls before voting.

The ACLU complaint says that requiring certain kinds of photo IDs as a prerequisite for voting puts a "severe burden" on the right to vote which violates the Equal Protection clause of the 14th Amendment.

AG says TN can require senior driving retesting

Tennessee can require seniors to retest for driver's license once they reach a certain age, says Attorney General Robert Cooper, in an opinion released on December 5.

The State can also modify tests for seniors, to take in consideration aging issues as they pertain to driving and require retesting if they are involved in accidents or if the family expresses concerns, Cooper opined.

Cooper said that it would not be necessary for the State to enact legislation to allow physicians to relay information to the Department of Safety if he were concerned that a seniors health would impair his driving.

HIPAA regulations allow a healthcare provider to provide protected health information to public officials where the it has a good faith belief that disclosure is necessary to protect public health, the opinion states.

Cooper responded to questions posed by District 65 Rep. Eddie Bass.

GOP Becky Duncan Massey, executive director of the Knoxville Sertoma Center and sister of U.S. Rep. John J. Duncan Jr., won the District 6 State Senate, over Democrat Gloria Johnson, in Knoxville's special election yesterday.

Unofficial totals have Massey the winner with 10,005 votes, which accounted for 64 percent of all votes cast. Johnson pulled in 5,735 votes or 36 percent of all votes cast.
The seat became vacant when the former State Senator and speaker pro tempore Jamie Woodson resigned to head a private education reform organization. The seat is being filled by interim Senator Sue Atchley.

Haslam names Dr. John Dreyzhner as new Commissioner of Health

Gov. Bill Haslam, today, named Dr. John Dreyshner as new Commissioner of Health, replacing outgoing Commissioner Susan Cooper.

Dreyzehner, 48, currently serves as director of the Cumberland Plateau Health District in Southwest Virginia. During his nine years in that role, he also spent two years serving as acting director of the Lenowisco Health District. Dreyzehner began his medical career as a United States Air Force flight surgeon, and prior to returning to public service with the Virginia Department of Health, he practiced occupational medicine as director of the Blue Ridge Occupational Health Clinic in Lebanon, Va.

Dreyzehner is adjunct faculty at East Tennessee State University College of Public Health, founding faculty of the Healthy Appalachia Institute and visiting assistant professor at the University of Virginia. He is also a fellow of the American College of Occupational and Environmental Medicine.

He currently serves on the Appalachian Regional Commission’s Health Policy Advisory Committee, as vice chair of the Southwest Virginia Health Authority, chairman of the board of One Care, Inc., chairman of the Mountain Empire Public Health Emergency Coordination Council, chair of the Virginia Tech Carilion School of Medicine Master of Public Health Advisory Committee and co-chair of the Appalachian Substance Abuse Coalition.

Dreyzehner served the Air Force as Chief of Aeromedical Assessment in the Office of the Command Surgeon at Langley Air Force Base, Chief of Flight Medicine in the 1^st Medical Group of the 1^st Fighter Wing, and as flight surgeon for the 94^th Fighter Squadron. In addition to his occupational medicine and public health practice, he has also practiced in the field of addiction medicine.

Amendment would add Level 1 Adult Care Homes in TN

An amendment to SB0595/HB0603 rewrites the bill to add Level 1 Adult Care Homes as an available option in Tennessee. Current law provides only for Level 2 Adult Care Homes which serve persons who suffered brain injury or are ventilator dependent.

The amendment creates a Level 1 Adult Care Homes to serve elderly or disabled adults who require assistance with activities of daily living, who do not have an illness, disability or injury that requires specialized services or continuous nursing care.

Both Levels may provide care for up to five elderly or disabled, however, a Level 1 home could not care for more than one bed-bound person, without an exception granted by the board for licensing health care facilities. The amendment provides for standards and to be promulgated.

The amendment requires that a Level 1 provider pass a competency test, and meet the eduction, experience and training requirements of a Level 1 provider.

A Level 2 provider, serving ventilator dependent residents or brain injured residents, must hold or employ a resident manager who is currently licensed as a physician, nurse practitioner, registered nurse, licensed rehabilitation professional or a licensed mental health professional who is trained and experienced the care of those types residents.

The amendment also provides requirements for substitute caregivers, for both Levels of the homes.

Democrat Antonio "2 Shay" Parkinson was elected to serve at state representative for House District 98.
